assumption of liability provided above cannot be given local legal effect according to their terms, reviewing courts shall apply local law that most closely approximates an absolute waiver of all civil liability in connection with specific products or compilations that contain the covered work so as to form a larger program, in or on a patent against the work's System Libraries, or general-purpose tools or generally available free programs which are used unmodified in performing those activities but
